MEMORANDUM OF UNDERSTANDING BETWEEN THE TAIPEI ECONOMIC AND CULTURAL REPRESENTATIVE OFFICE IN THE UNITED STATES AND THE AMERICAN INSTITUTE IN TAIWAN CONCERNING COOPERATION IN FISHERIES AND AQUACULTURE


  1
  
  The Taipei Economic and Cultural Representative Office in the U-nited States ("TECRO") and the American Institute in Taiwan ("A-IT") (together referred to herein as "the Parties" or individua-lly as a "Party");
  
  Noting that the authorities of the territory represented by AIT
  
  have consented to be bound by the 1995 Agreement for the Implem-entation of the provisions of the United Nations Convention onthe Law of the Sea of 10 December 1982 Relating to the Conserva-tion and Management of Straddling Fish Stocks and Highly Migrat-ory Fish Stocks ("1995 UN Fish Stocks Agreement") and the 1993FAO Agreement on Promoting Compliance with International Conser-vation and Management Measures by Fishing Vessels on the High S-eas ("1993 FAO Compliance Agreement");
  
  Bearing in mind that the need to achieve sustainable ocean fish-eries on a worldwide basis, as well as the effective implementa-tion of the 1995 UN Fish Stocks Agreement and the 1993 FAO Comp-liance Agreement, requires that all those concerned, includingStates and fishing entities, work together through appropriatearrangements;
  
  Acknowledging the need to establish legally effective mechanismsto facilitate the participation by the authorities of the terri-tory represented by the authorities of the territory representedby TECRO in global, regional and subregional fisheries organiza-tions on an equitable basis;
  
  Recognizing that the authorities represented by TECRO have volu-ntarily implemented UNGA Resolution 46/215 since its adoption;Desiring, through their designated representatives, to cooperateand work towards a mutually beneficial relationship in the fieldof fisheries and aquaculture;
  
  Represent as follows:
  
  1 The Parties intend to cooperate, to the extent possible and t-hrough their respective designated representatives, in the im-plementation of the provisions of:
  
  i the 1995 FAO Code of Conduct for Responsible Fisheries; andii the International Plans of Action for the Management of Fi-shing Capacity, for the Conservation and Management of Sha-
  
  rks, for Reducing Incidental Catch of Seabirds in Longline
  
  Fisheries, and for Preventing, Deterring and Eliminating I-
  
  llegal, Unreported and Unregulated Fishing, as adopted by
  
  the FAO.
  
  2 TECRO provides assurances that, through its designated repres-entatives, it shall implement fisheries conservation and mana-gement measures and regulate the activities of fishing vesselsregistered in the territory it represents on the basis of the1995 UN Fish Stocks Agreement and, upon its entry into force,the 1993 FAO Compliance Agreement.
  
  3 AIT provides assurances that, through its designated represen-tatives, it will endeavor to assist the authorities of the te-rritory represented by TECRO to participate equitably in glob-al, regional and subregional fisheries organizations.
  
  4 The Parties, through their desigated representatives, shall s-eek to promote sustainable fisheries through the effective op-eration of global, regional and subregional fisheries managem-ent organizations and arrangements in which they both partici-pate. For the purposes of effective cooperation between the P-arties, bilateal consultations may be held prior to annual me-etings of such global, regional and subregional fisheries man-agement organizations and arrangements.
  
  5 The Parties, through their designated representatives, shallcontinue to cooperate, consistent with the laws and regulatio-ns of the territories they represent, in the implementation ofterritories they represent, in the implementation of UNGA Res-olution 46/215, and shall also take action against individuals, corporations and vessels subject to those laws and regulati-ons that may engage in large-scale high seas driftnet fishingoperations in the North Pacific Ocean.
  
  6 The Parties, through their designated representatives and sub-ject to the availability of resources, agree to:
  
  i exchange information on fisheries and aquaculture research
  
  and relevant scientific reports and publications;
  
  ii conduct joint studies and training programs on fisheries a-nd aquaculture;
  
  iii exchange visits of fisheries and aquaculture personnel ;
  
  and
  
  iv strangthen existing cooperation between their respective d-esignated representatives in the field of fisheries enforc-
  
  ement.
  
  7 For the purposes of this Memorandum of Understanding, the term"designated representatives" refers to:
  
  for AIT: the United Stated Department of Commerce, the UnitesStates Coast Guard and other appropriate agencies;
  
  for TECRO: the Council of Agriculture, the coast Guard Admini-stration and other appropriate agencies.
  
  8 The parties, through their designated representatives, agreeto consult periodically on matters in relation to fisheries a-nd aquaculture, and any other matters arising from the implem-entation of this Memorandum of Understanding.
  
  9 This Memorandum of Understanding shall become effective on thedate of the last signature hereinafter and shall remain effec-tive for five years from the date. This Memorandum of Underst-anding may be extended by written agreement of the Parties.
  
  10 Either Party may terminate this Memorandum of Understandingby a written notice to the other Party ninety (90) days priorto the intended date of termination.
  
  IN WITNESS WHEREOF, the undersigned, being duly authorized, havesigned this Memorandum of Understanding
