CAP 1013 CHINESE YOUNG MEN'S CHRISTIAN ASSOCIATION ORDINANCE

To provide for the incorporation of the Directors of the Chinese Young Men's Christian Association of Hong Kong. [27 May 1932] (Originally 16 of 1932 (Cap. 276 of 1950)) Cap 1013 s 1 Short title This Ordinance may be cited as the Chinese Young Men's Christian Association Ordinance. Cap 1013 s 2 Interpretation Remarks: Adaptation amendments retroactively made - see 32 of 1999 s. 3 In this Ordinance, unless the context otherwise requires- "constitution" (宪章) means the constitution of the Chinese Young Men's Christian Association of Hong Kong as set out in the Schedule hereto, or any amended constitution approved by the Chief Executive which may be made thereunder. (Amended 32 of 1999 s. 3) Cap 1013 s 3 Incorporation Remarks: Adaptation amendments retroactively made - see 32 of 1999 s. 3 (1) The directors of the Chinese Young Men's Christian Association of Hong Kong, and their successors in office as hereinafter defined, shall be a body corporate, hereinafter called the corporation, and shall have the name of "The Director of the Chinese Young Men's Christian Association of Hong Kong", and in that name shall have perpetual succession, and shall and may sue and be sued in all courts in Hong Kong and shall and may have and use a common seal. (Amended 32 of 1999 s. 3) (2) Directors, whether appointed in immediate succession to any of the first directors or not, shall be appointed in accordance with the constitution, and shall for the time being be deemed to be successors in office of the first directors and to be members of the corporation. Cap 1013 s 4 Powers of corporation (1) The corporation shall have power to acquire, accept leases of, purchase, take, hold and enjoy any lands, buildings, messuages or tenements of what nature or kind soever and wheresoever situate, and also to invest moneys upon mortgage of any lands, buildings, messuages, or tenements, or upon the mortgages, debentures, stocks, funds, shares or securities of any corporation or company, and also to purchase, acquire and possess steam-launches, boats and other goods and chattels of what nature and kind soever. (2) The corporation shall further have power by deed under its seal to grant, sell, convey, assign, surrender, exchange, partition, yield up, mortgage, demise, reassign, transfer or otherwise dispose of any lands, buildings, messuages, tenements, mortgages, debentures, stocks, funds, shares or securities, steam-launches, boats, or other goods and chattels, which are for the time being vested in or belonging to the corporation upon such terms as to the corporation may seem fit. Cap 1013 s 5 Execution of documents All deeds and other instruments requiring the corporate seal of the corporation shall be sealed in the presence of 2 of the directors and shall be signed by 2 of the directors. Cap 1013 s 6 Internal management All matters of internal management, including any amendment of the constitution, shall be settled and carried out in accordance with the constitution. Cap 1013 s 7 Saving Remarks: Adaptation amendments retroactively made - see 32 of 1999 s. 3 Nothing in this Ordinance shall affect or be deemed to affect the rights of the Central Authorities or the Government of the Hong Kong Special Administrative Region under the Basic Law and other laws, or the rights of any body politic or corporate or of any other persons except such as are mentioned in this Ordinance and those claiming by, from or under them. (Amended 32 of 1999 s. 3) Cap 1013 SCHEDULE Remarks: Adaptation amendments retroactively made - see 32 of 1999 s. 3 [section 2] CONSTITUTION OF THE CHINESE YOUNG MEN'S CHRISTIAN ASSOCIATION OF HONG KONG ARTICLE I-NAME AND GENERAL POLICY Paragraph 1. The name of the Association shall be the "Chinese Young Men's Christian Association of Hong Kong". Paragraph 2. The object and purpose of the Association shall be the development of Christian character and the cultivation of the Christian spirit of service among young men, in accordance with the teachings of Jesus Christ. Paragraph 3. The Association shall engage in no political movement, and shall not permit its name or premises to be used for political agitation or meetings. ARTICLE II-MEMBERSHIP Paragraph 4. Membership in the Association shall be open to men of the Chinese race who are Christians and are over 18 years of age. Paragraph 5. The procedure for admission to membership in the Association shall be as follows- (a) the candidate shall apply in person for membership; (b) the candidate shall be recommended by a member or a secretary of the Association; (c) every application shall be considered by the Membership committee and, if approved, the applicant shall become a member forthwith. Paragraph 6. The duties, responsibilities and privileges or a member of the Association shall be as follows- (a) to make plans for the carrying out of the objects and purposes of the Association and to work for the extension of its several activities; |
