[接上页] (2) Any person who uses and operates, or permits to be used and operated, any dumb lighter in any area of the waters of Hong Kong other than the area specified in the conditions of the licence issued in respect of the vessel shall be guilty of an offence and shall be liable on conviction to a fine of $10000. (L.N. 258 of 1974) (L.N. 33 of 1970) Cap 313F reg 46 Water boats (1) When applying for a licence for a water boat, the applicant shall produce to the Director a certificate from the Assistant Director of Marine (Ship Surveys) certifying that the hull, tanks, piping and all other fittings are in good condition. No licence shall be issued to any water boat unless that boat is constructed of steel. (2) Except with the written permission of the Director of Health, no water shall be taken into any water boat from any source other than the Government Waterworks at Aberdeen, Lai Chi Kok, Shau Kei Wan or the Taikoo Sugar Refinery at Quarry Bay. Such permission will be given only for limited periods in the discretion of the Director of Health. (L.N. 76 of 1989) Cap 313F reg 47 Conveyance of passengers Class III, Class IV and Class V Vessels The Director may, on occasion, permit persons other than the crew to be on board vessels of Classes III, IV and V provided that the number of persons so permitted shall not exceed the number which would be allowed if the vessel were licensed to carry passengers and measured in accordance with regulation 20. Cap 313F reg 47A Conveyance of passengers Class VI Vessels On no occasion, except in the case of shipwreck, fire, or other emergency, shall passengers be carried in Class VI vessels. (L.N. 273 of 1983) Cap 313F reg 47B Meaning of construction Expanded Cross Reference: 47C,D,E,F,G,H,I,J,K,L Class VIII Vessels For the purposes of regulations 47C to 47L, "construction" (建造) in relation to a Class VIII vessel includes the conversion of any vessel to a Class VIII vessel. (L.N. 273 of 1983) Cap 313F reg 47C Consent required for construction of Class VIII vessel (1) No person shall commence or carry out the construction of a Class VIII vessel without having first obtained the permission, in writing, of the Director. (2) The Director shall not permit the construction of a Class VIII vessel unless he has, in writing, approved- (a) the site at which the vessel will operate; and (b) the plans and specifications for the construction of the vessel.(3) An application for approval of the site at which a Class VIII vessel will operate shall be submitted to the Director in accordance with Form 1 in the Fourteenth Schedule and shall be accompanied by- (a) 5 copies of plans showing the proposed site and the proposed facilities, including any facilities on land for the embarkation of persons on and the disembarkation of persons from the vessel; and (b) the prescribed fee (if any).(4) An application for approval of the plans and specifications for construction of a Class VIII vessel shall be submitted to the Director in accordance with Form 2 in the Fourteenth Schedule and shall be accompanied by- (a) 5 copies of such plans and specifications including such other particulars as are required by the Director; and (b) the prescribed fee (if any).(5) No application shall be submitted under paragraph (4) in respect of any Class VIII vessel unless- (a) the site at which the vessel will operate has been approved; or (b) the Director so requests.(6) The Director may return any application made under this regulation if, in his opinion, the application- (a) does not comply with this regulation; or (b) is otherwise deficient or incomplete,and may request further plans, specifications or particulars on any matter. (7) The Director may refuse to give his approval in respect of any application made under this regulation where under paragraph (6)- (a) the application has been returned to the applicant; or (b) any further plans, specifications or particulars delivered to the Director are not to his satisfaction.(8) Any person who contravenes paragraph (1) commits an offence and is liable to a fine of $20000 and to imprisonment for 1 year. (L.N. 273 of 1983) Cap 313F reg 47D Refusal to approve (1) Without prejudice to any other provision of these regulations, the Director may refuse to give his approval in respect of any application under regulation 47C if, in his opinion- (a) having regard to proper standards of health, safety or navigation, the proposed site is unsuitable; (b) the proposed facilities (including any facilities on land for the embarkation of persons on or the disembarkation of persons from the vessel) are inadequate; (c) having regard to the purposes for which it will be used, the vessel will be unseaworthy; (d) the vessel will be otherwise unfit or unsuited for use as a Class VIII vessel; or (e) there is other reasonable cause.(2) Where the Director has refused to give his approval in respect of any application under regulation 47C, he shall forthwith notify the applicant, in writing, of his refusal and of the reasons therefor. |
