CAP 519A RAILWAYS (EXEMPTION) ORDER

(Cap 519 section 45(2)(a)) [17 October 1997](L.N. 466 of 1997) Cap 519A s 1 Interpretation In this Order- "appointed date" (指定日期) means the appointed date within the meaning of section 45 of the Ordinance; "existing railway" (现有铁路) means an existing railway within the meaning of section 45 of the Ordinance; "railway" (铁路) means the railway defined as such under section 2 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). Cap 519A s 2 Exemption (1) Subject to subsection (2), the parts of the railway specified in the Schedule are exempted from the operation of the Ordinance. (2) The exemption under subsection (1) shall as from the appointed date cease to have effect in respect of any part of the railway specified in the Schedule, unless that part of the railway is, immediately before the appointed date, an existing railway. Cap 519A SCHEDULE [section 2] 1. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 2A", and deposited in the Land Registry on 28 December 1976 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 2. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 5A", and deposited in the Land Registry on 28 December 1976 under section 3 of the Mass Transit Railway (Land resumption and Related Provisions) Ordinance (Cap 276). 3. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 9A", and deposited in the Land Registry on 2 February 1978 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 4. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 15C", and deposited in the Land Registry on 27 March 1984 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 5. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 23B", and deposited in the Land Registry on 10 February 1987 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 6. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 3B", and deposited in the Land Registry on 24 February 1989 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 7. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 11B", and deposited in the Land Registry on 9 January 1990 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 8. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 1E", and deposited in the Land Registry on 16 January 1990 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 9. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 4B", and deposited in the Land Registry on 19 January 1990 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 10. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 10A", and deposited in the Land Registry on 19 August 1991 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 11. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 20B", and deposited in the Land Registry on 28 June 1993 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 12. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 25", and deposited in the Land Registry on 25 March 1994 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 13. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 26", and deposited in the Land Registry on 25 March 1994 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 14. The part of the railway the area of which has been delineated as railway area on a plan marked "RAILWAY AREA PLAN NO. 27", and deposited in the Land Registry on 25 March 1994 under section 3 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Cap 276). 15.
