(Cap 301 section 3(1AA) and (1A)) [20 June 1997] L.N. 349 of 1997 (L.N. 218 of 1997) Cap 301D s 1 (Omitted as spent) (Omitted as spent) Cap 301D s 2 Interpretation In this Order, unless the context otherwise requires- "plans approved by the Building Authority" (建筑事务监督批准的图则) means plans approved under the Buildings Ordinance (Cap 123) by the Building Authority as defined in the Buildings Ordinance (Cap 123) or under the Buildings Ordinance 1935 (18 of 1935) and which are available for inspection by the public at the office of the Buildings Department. Cap 301D s 3 Prescribed areas and restriction of heights of buildings (1) Each of the areas delineated in red on the plans specified in subsection (2) is an area within which no building shall exceed the height above the principal datum (referred to in the plans as "the restricted height") specified in the plans in relation to that area. (2) The plans referred to in subsection (1) are plans under series AHRP named Sheet HKE, Sheet HKW, Sheet 5-SE-B, Sheet 5-SE-D, Sheet 6-SW-A, Sheet 6-SW-B, Sheet 6-SW-C, Sheet 6-SW-D, Sheet 6-SE-A, Sheet 6-SE-C, Sheet 6-SE-D, Sheet 9-NW-D, Sheet 9-NE-B, Sheet 9-NE-C, Sheet 9-NE-D, Sheet 9-SW-B, Sheet 9-SE-A, Sheet 9-SE-B, Sheet 10-NW-A, Sheet 10-NW-B, Sheet 10-NW-C, Sheet 10-NW-D, Sheet 10-NE-A, Sheet 10-NE-B, Sheet 10-NE-C, Sheet 10-NE-D, Sheet 10-SW-A, Sheet 10-SW-B, Sheet 10-SE-A, Sheet 10-SE-B, Sheet 11-NW-A, Sheet 11-NW-B, Sheet 11-NW-C, Sheet 11-NW-D, Sheet 11-SW-A, Sheet 11-SW-B, Sheet 11-SW-C, Sheet 11-SE-A, Sheet 11-SE-C, Sheet 11-SE-D, Sheet 12-SW-C, Sheet 14-NW-B, Sheet 14-NW-D and Sheet 16-NW-A signed by the Secretary for Planing, Environment and Lands and deposited in the Land Registry. Cap 301D s 4 (Repealed L.N. 116 of 1998) Cap 301D s 5 Disapplication This Order shall not apply to- (a) any building erected in accordance with plans approved by the Building Authority before the commencement of this Order; (b) any building that, at the time of erection, was exempted from the provisions of the Buildings Ordinance (Cap 123) by virtue of section 41(1)(a) of that Ordinance; (c) any building that, at the time of erection, was exempted from the provisions of the Buildings Ordinance (Cap 123) by virtue of section 41(1)(aa) of that Ordinance and is erected by or on behalf of the Housing Authority in accordance with plans endorsed by the Housing Authority before the commencement of this Order; and (d) any building erected before the commencement of this Order that, at the time of erection, was exempted from the provisions of the Buildings Ordinance (Cap 123) by virtue of section 41(1)(b) of that Ordinance. |
