CAP 400F NOISE CONTROL ORDINANCE (EXEMPTION FROM SECTION 6(1) AND (2) (LANTAU FIXED CROSSING)) ORDER

(Cap 400 section 35(1)) [20 September 1991] (L.N. 362 of 1991) Cap 400F para 1 Citation This order may be cited as the Noise Control Ordinance (Exemption from Section 6(1) and (2) (Lantau Fixed Crossing)) Order. (Enacted 1991) Cap 400F para 2 Exemption Subject to paragraph 3, section 6(1) and (2) of the Ordinance shall not apply to the construction of the Tsing Ma Bridge and Kap Shui Mun Bridge/Ma Wan Viaduct components of the Lantau Fixed Crossing including the site formation and associated tunnelling work to be carried out within the areas specified in Schedule 1 effective from the *date of the publication of this order in the Gazette until the expiry date of this order on 31 May 1997. (* 20 September 1991) (Enacted 1991) Cap 400F para 3 Conditions The exemption in paragraph 2 is granted subject to the conditions detailed in Schedule 2. (Enacted 1991) Cap 400F para 4 Emergency The conditions imposed by paragraph 3 shall not apply in the case of emergency work necessary to save life or property or for the safety of the works. (Enacted 1991) Cap 400F para 5 Control The control of the exemption shall be by way of conditions of contract incorporating the principles described in Schedule 3. (Enacted 1991) Cap 400F Sched 1 [paragraph 2] The locations and the works boundaries for the 24-hour construction of the Lantau Fixed Crossing are more particularly delineated in Drawing Nos. 272/TM/1106 and 272/TM/1107 for the Tsing Ma Bridge Contract and Drawing Nos. 272/KSM/1105 and 272/KSM/1106 for the Kap Shui Mun Bridge/Ma Wan Viaduct Contract deposited in the office of the Highways Department at 10th Floor, Empire Centre at Tsim Sha Tsui East. (Enacted 1991) Cap 400F Sched 2 CONDITIONS OF EXEMPTION [paragraph 3] Noise mitigation requirements 1. Works associated with Tsing Ma Bridge Contract The following maximum allowable noise levels resulting from the works associated with the Tsing Ma Bridge Contract, in dB(A), shall not be exceeded at various noise sensitive receivers (NSRs) indicated in Table 1- TABLE 1 TSING MA BRIDGE CONTRACT MAXIMUM ALLOWABLE NOISE LEVELS Restricted Periods Areas of Noise Sensitive Receivers (as shown on the map annexed to this Schedule) Ma Wan North Lantau (Sam Po Tsui, Tai Chuen and Yi Chuen) Ting Kau, Sham Tseng and Tsing Lung Tau 0700-1900 General Holidays +1900-2300 All Days 75 75 60 2300-0700 All Days 70 70 55 2. Works associated with Kap Shui Mun Bridge/Ma Wan Viaduct Contract The following maximum allowable noise levels resulting from the works associated with the Kap Shui Mun Bridge/Ma Wan Viaduct Contract, in dB(A), shall not be exceeded at various NSRs indicated in Table 2- TABLE 2 KAP SHUI MUN BRIDGE/MA WAN VIADUCT CONTRACT MAXIMUM ALLOWABLE NOISE LEVELS Restricted Periods Areas of Noise Sensitive Receivers (as shown on the map annexed to this Schedule) Ma Wan North Lantau (Sam Po Tsui, Tai Chuen and Yi Chuen) North Lantau (Tso Wan and Ngong Shuen Au) Ting Kau, Sham Tseng and Tsing Lung Tau 0700-1900 General Holidays +1900-2300 All Days 75 75 60 60 2300-0700 All Days 70 70 55 55 (Enacted 1991) Cap 400F Sched 3 CONDITIONS OF CONTRACT TO BE INCLUDED [paragraph 5] Conditions of contract adopting the principles set out below shall be incorporated in all relevant contracts and shall thereafter be implemented- 1. Each contractor shall be given permission to work within the periods set out in Tables 1 and 2 of Schedule 2 provided that works under its contract do not produce noise which exceeds the levels indicated in Schedule 2. 2. The engineer shall have a duty- (a) to monitor the noise in accordance with the principles described in the Annex to this Schedule; and (b) to instruct the contractor to take remedial measures where there is breach. 3. If so instructed by the engineer, the contractor shall have an obligation to take appropriate remedial action. 4. If the contractor fails to remedy the breach, the engineer shall be empowered to specify remedial action. 5. The engineer shall be empowered to require breaches to be remedied immediately and shall be under a duty generally to do so. However, if in the view of the engineer it would be impossible for the contractor to remedy the breach immediately, the engineer shall be empowered, having had regard to- (a) the seriousness of the consequence of the breach; and (b) the remedial action required,to permit the contractor on an exceptional basis the minimum period necessary for the contractor to comply with his instruction which shall not in any event exceed 7 days unless the engineer shall certify that the relevant circumstances are extraordinary. 6. If the contractor fails to remedy the breach within such time as shall have been specified in the engineer's instruction, the engineer shall have a duty to suspend the works or any part of the works. 7. Where work is essential for the safety of life, property or the works, there shall be a general exclusion from the obligations of the contractor to comply with the conditions of exemption set out in Schedule 2. |
