[接上页] (Enacted 1996) Cap 161D s 9 Duties of Secretary in inquiry by Council At every inquiry under section 21 of the Ordinance, the Secretary has the following duties- (a) to read the notice of inquiry; (b) in the absence of the defendant or his solicitor or counsel at the opening of an inquiry, to furnish to the Council such evidence as the Council may require to prove that the notice of inquiry was served on the defendant concerned; (c) to present the case and close the case against the defendant; (d) at the conclusion of the case of the defendant, to address the Council in reply; (e) when sentence on the defendant is to be decided, to produce to the Council past records of any meeting of the Council at which an order has been made against the defendant pursuant to section 21 or 21A of the Ordinance; (f) such other duties which are to be discharged by the Secretary under the Medical Practitioners (Registration and Disciplinary Procedure) Regulation (Cap 161 sub. leg.) and the Medical Practitioners (Electoral Provisions) (Procedure) Regulation (Cap 161 sub. leg.).
