第6/2002号行政长官公告，命令公布中华人民共和国作为一九三零年六月七日於日内瓦签署的《汇票和本票印花税法公约》（及其议定书）的缔约国作出的有关将该公约继续适用於澳门特别行政区的通知书。

监於中华人民共和国已於一九九九年十月十九日通知作为一九三零年六月七日於日内瓦签署的《汇票和本票印花税法公约》（及其议定书） 保管实体之联合国秘书长，有关公约将继续在澳门特别行政区适用。 行政长官根据澳门特别行政区第3/1999号法律第六条第一款的规定，命令公布中华人民共和国作出的有关通知书。该通知书的中文本、与送交保管实体的文本相符的英文本，以及有关的葡文译本附同於本公告。 二零零二年二月一日发布。 行政长官 何厚铧 通 知 “ （...）根据一九八七年四月十三日签署的《中华人民共和国政府和葡萄牙共和国政府关於澳门问题的联合声明》（以下简称《联合声明》），中华人民共和国政府将於一九九九年十二月二十日对澳门恢复行使主权。自该日起，澳门将成为中华人民共和国的一个特别行政区，除外交和国防事务属中华人民共和国中央人民政府管理外，享有高度自治权。 《联合声明》附件一《中华人民共和国政府对澳门的基本政策的具体说明》第八节和中华人民共和国全国人民代表大会於一九九三年三月三十一日通过的《中华人民共和国澳门特别行政区基本法》第一百三十八条均规定，中华人民共和国尚未参加但已适用於澳门的国际协议仍可继续适用。 根据上述规定，我奉中华人民共和国外交部长之命通知如下： 目前适用於澳门的一九三零年六月七日订於日内瓦的《汇票及本票印花税法公约》及其议定书（以下简称该公约及其议定书），自一九九九年十二月二十日起继续适用於澳门特别行政区。 在上述范围内，该公约及其议定书当事方的国际权利和义务将由中华人民共和国政府承担。（...）” Notification "(...) In accordance with the Joint Declaration of the Government of the People's Republic of China and the Government of the Republic of Portugal on the Question of Macao (hereinafter referred to as the Joint Declaration), the Government of the People's Republic of China will resume the exercise of sovereignty over Macao with effect from 20 December 1999. Macao will, from that date, become a Special Administrative Region of the People's Republic of China and will enjoy a high degree of autonomy, except in foreign and defense affairs, which are the responsibilities of the Central People's Government of the People's Republic of China. It is provided both in Section VIII of Elaboration by the Government of the People's Republic of China of its Basic Policies Regarding Macao, which is Annex I to the Joint Declaration, and Article 138 of the Basic Law of the Macao Special Administrative Region of the People's Republic of China, which was adopted on 31 March 1993 by the National People's Congress of the People's Republic of China, that international agreements to which the People's Republic of China is not yet a party but which are implemented in Macao may continue to be implemented in the Macao Special Administrative Region. In accordance with the above provisions, I am instructed by the Minister of Foreign Affairs of the People's Republic of China to inform Your Excellency of the following: The Convention on the Stamp Laws in Connection with Bills of Exchange and Promissory Notes (and Protocol), done at Geneva on 7 June 1930 (hereinafter referred to as the "Convention and the Protocol"), which applies to Macao at present, will continue to apply to the Macao Special Administrative Region with effect from 20 December 1999. Within the above ambit, the Government of the People's Republic of China will assume the responsibility for the international rights and obligations that place on a Party to the Convention and the Protocol. De acordo com a Declara??o Conjunta do Governo da República Popular da China e do Governo da República Portuguesa sobre a Quest?o de Macau (de ora em diante designada por Declara??o Conjunta), o Governo da República Popular da China reassumirá o exercício da soberania sobre Macau com efeito a partir de 20 de Dezembro de 1999. Macau tornar-se-á, a partir dessa data, uma Regi?o Administrativa Especial da República Popular da China e gozará de um alto grau de autonomia, excepto nos assuntos das rela??es externas e da defesa, que s?o da responsabilidade do Governo Popular Central da República Popular da China. Encontra-se estipulado na Sec??o VIII do "Esclarecimento do Governo da República Popular da China sobre as Políticas Fundamentais Respeitantes a Macau", que constitui o Anexo I da Declara??o Conjunta, e no artigo 138.o da Lei Básica da Regi?o Administrativa Especial de Macau da República Popular da China, adoptada em 31 de Mar?o de 1993 pela Assembleia Popular Nacional da República Popular da China, que os acordos internacionais de que a República Popular da China ainda n?o é parte, mas que s?o aplicados em Macau, poder?o continuar a aplicar-se na Regi?o Administrativa Especial de Macau. Em conformidade com os supracitados preceitos, fui instruído pelo Ministro dos Negócios Estrangeiros da República Popular da China para informar Vossa Excelência do seguinte: A Conven??o relativa ao Imposto de Selo em Matéria de Letras e de Livran?as (e Protocolo), feita em Genebra em 7 de Junho de 1930 (de ora em diante designada por "Conven??o e Protocolo"), actualmente aplicável em Macau, continuar-se-á a aplicar na Regi?o Administrativa Especial de Macau, com efeito a partir de 20 de Dezembro de 1999. Neste ambito, o Governo da República Popular da China assumirá a responsabilidade pelos direitos e obriga??es internacionais de Parte da Conven??o e Protocolo. (...)" |
