(L.N. 188 of 1999)(4) (a) In respect of the lettering and characters of the English version of the health warning and indication of tar and nicotine yields borne on packets of cigarettes containing 20 or more cigarettes- (i) "HKSAR GOVERNMENT HEALTH WARNING" and the indication of tar and nicotine yields shall be printed in 6.5 point Univers Bold typeface, all capitals (except "mg"); and (ii) the rest of the health warning shall be printed in 11 point Univers Bold typeface, all capitals. (b) In respect of the lettering and characters of the Chinese version of the health warning and indication of tar and nicotine yields borne on packets of cigarettes containing 20 or more cigarettes- (i) "特区政府忠告市民" and the indication of tar and nicotine yields shall be printed in 7 kyu (级) (华康中黑体) typeface; and (ii) the rest of the health warning shall be printed in 14 kyu (级) (华康中黑体) typeface.(c) The area containing the health warning and indication of tar and nicotine yields referred to in sub-subparagraph (a) or (b) shall measure 50 mm x 24 mm. (L.N. 188 of 1999)(4A) (a) In respect of the lettering and characters of the English version of the health warning and indication of tar and nicotine yields borne on retail containers of cigarette packets containing any number of cigarettes- (i) "HKSAR GOVERNMENT HEALTH WARNING" and the indication of tar and nicotine yields shall be printed in 11 point Univers Bold typeface, all capitals (except "mg"); and (ii) the rest of the health warning shall be printed in 22 point Univers Bold typeface, all capitals. (b) In respect of the lettering and characters of the Chinese version of the health warning and indication of tar and nicotine yields borne on retail containers of cigarette packets containing any number of cigarettes- (i) "特区政府忠告市民" and the indication of tar and nicotine yields shall be printed in 12 kyu (级) (华康中黑体) typeface; and (ii) the rest of the health warning shall be printed in 26 kyu (级) (华康中黑体) typeface.(c) The area containing the health warning and indication of tar and nicotine yields referred to in sub-subparagraph (a) or (b) shall measure 100 mm x 48 mm. (L.N. 188 of 1999)(5) The area containing the health warning and indication of tar and nicotine yields shall be rectangular in shape, as indicated in the Schedule, and the sides of the area, and any line demarcating such sides, shall not touch any letter or character within the area. (L.N. 188 of 1999) (6) No health warning or indication of tar and nicotine yields shall appear- (a) across any opening in the packet or container or upon any part of a packet which is removed when it is opened; or (b) in such a manner that it is obscured by any affixture to the packet, container or its wrapping. (L.N. 188 of 1999)(6A) here a packet or retail container is in the form of a drum, the English version of the health warning and indication of tar and nicotine yields shall appear on the lid and the Chinese version on the curved surface of the drum. (L.N. 188 of 1999) (7) The health warning and indication of tar and nicotine yields which is to be borne on packets of cigarettes and on the retail containers of cigarette packets may be printed on a label securely affixed to the packets or containers- (L.N. 188 of 1999) (a) if the packets or containers are of metal or are plastic drums; (b) with the approval of the Commissioner of Customs and Excise where he is satisfied- (i) the circumstances in which the packets or containers are in Hong Kong, or are to be brought to Hong Kong, are such that they could not reasonably be expected to have had printed on them a warning and indication of tar and nicotine yields at the time of their manufacture; and (L.N. 188 of 1999) (ii) the approval is required for a limited period of time or in relation to a particular consignment of cigarettes only. (L.N. 61 of 1983) Cap 371B para 4 (Repealed L.N. 188 of 1999) Cap 371B para 4A Cigars, pipe tobacco and cigarette tobacco (1) Paragraph 3(2)(b) (except the reference to subparagraph (7)) to (e), (3), (5), (6) and (6A) and Part IIA of the Schedule shall apply in the case of the health warning to be borne on packets, containers, drums or wrapping containing cigars, pipe tobacco and cigarette tobacco, save that the indication of tar and nicotine yields shall not be borne thereon. (2) The area containing the health warning shall be rectangular in shape and its size shall be at least 20% of the surface area on which the health warning appears and in any case not smaller than 50 mm x 24 mm. (3) Where the area containing the health warning measures 50 mm x 24 mm, the lettering and characters of the health warning shall be as follows- (a) (in respect of the English version of the health warning) "HKSAR GOVERNMENT HEALTH WARNING" in 6.5 point Univers Bold typeface, all capitals, and the rest of the health warning in 11 point Univers Bold typeface, all capitals; and |
