[接上页] Notification of 1 November 2000 "The Embassy of the People's Republic of China to the Kingdom of the Netherlands (...) has the honor to refer to the Embassy's Note No. He Wai Fa (99)-141 forwarded (...) on 10 December 1999, which confirmed that the Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters, concluded at The Hague on 15 November 1965 (hereinafter referred to as "the Convention"), would apply to the Macao Special Administrative Region of the People's Republic of China with effect from 20 December 1999. (...) the Embassy is instructed to inform the following amendments with respect to the contents of the above-mentioned Note: 1. The reference in the above-mentioned Note that "in accordance with article 6 and article 9 of the Convention, it designates the Procuratorate, the Primary Courts, the Intermediate Courts and the Court of Final Appeal of the Macao Special Administrative Region" shall be amended as follows: "In accordance with Article 18 of the Convention, it designates the Procuratorate of the Macao Special Administrative Region as the Other Authority in the Macao Special Administrative Region, which will undertake to receive and transmit Requests for Services coming from other Contracting States. In accordance with Article 6 of the Convention, it designates the Court Clerks and Assistant Court Clerks from the Court of Final Appeal of the Macao Special Administrative Region as the authority competent to complete a certificate referred to in this Article. In accordance with Article 9 of the Convention, it designates the Court Clerks and Assistant Court Clerks from the Court of Final Appeal of the Macao Special Administrative Region as the authority competent to receive Requests for Service forwarded by other Contracting States through consular channels. The address of the Procuratorate of the Macao Special Administrative Region is: Alameda Dr. Carlos d'Assump??o Macao SAR of the People's Republic of China Chief Executive Administrative Building NAPE Macao" 2. The Government of the People's Republic of China also wishes to make the following supplementary declaration: "In accordance with paragraph 3 of Article 5 of the Convention, it declares that documents to be served in the Macao Special Administrative Region under the first paragraph of Article 5 shall be written in either Chinese or Portuguese, or be accompanied by a translation in either Chinese or Portuguese". Notifica??o de 1 de Novembro de 2000 "A Embaixada da República Popular da China no Reino dos Países Baixos (...) tem a honra de se referir à Nota da Embaixada n.o He Wai Fa (99)-141 enviada (...) em 10 de Dezembro de 1999, que confirmou que a Conven??o relativa à Cita??o e à Notifica??o no Estrangeiro dos Actos Judiciais e Extrajudiciais em Matérias Civil e Comercial, concluída na Haia, em 15 de Novembro de 1965 (de ora em diante designada por "Conven??o") se aplicará na Regi?o Administrativa Especial de Macau da República Popular da China com efeito a 20 de Dezembro de 1999. (...) a Embaixada foi instruída para comunicar as seguintes altera??es ao teor da supracitada notifica??o: 1. A supracitada notifica??o, onde nela se refere "nos termos dos artigos 6.o e 9.o da Conven??o, designa o Ministério Público, os Tribunais de Primeira Instancia, os Tribunais de Segunda Instancia e os Tribunais de última Instancia da Regi?o Administrativa Especial de Macau" será alterada como segue: "Em conformidade com o artigo 18.o da Conven??o, designa-se o Ministério Público da Regi?o Administrativa Especial de Macau como a outra autoridade na Regi?o Administrativa Especial de Macau a quem compete receber e transmitir os pedidos de cita??o e notifica??o provenientes de outros Estados contratantes. Em conformidade com o artigo 6.o da Conven??o, designam-se os escriv?es de direito e os escriv?es adjuntos do Tribunal de última Instancia da Regi?o Administrativa Especial de Macau como a autoridade competente para emitir o certificado a que se refere este artigo. Em conformidade com o artigo 9.o da Conven??o, designam-se os escriv?es de direito e os escriv?es adjuntos do Tribunal de última Instancia da Regi?o Administrativa Especial de Macau como a autoridade competente para receber os pedidos de cita??o ou notifica??o transmitidos por outros Estados contratantes por via consular. A morada do Ministério Público da Regi?o Administrativa Especial de Macau é: Alameda Dr. Carlos d'Assump??o Edifício Administrativo do Chefe do Executivo da RAE de Macau da República Popular da China NAPE Macau" 2. O Governo da República Popular da China deseja ainda fazer a seguinte declara??o suplementar: "Em conformidade com o parágrafo 3 do artigo 5.o da Conven??o, declara que os actos que devam ser objecto de cita??o ou de notifica??o na Regi?o Administrativa Especial de Macau ao abrigo do 1 parágrafo do artigo 5.o, ter?o de ser redigidos em chinês ou português, ou acompanhados de tradu??o para chinês ou português." |
