[接上页] (2) Before issuing a certificate of proficiency in fast rescue boats, the Authority may require the applicant to produce to him certificates or other documents showing to his satisfaction that the applicant has fulfilled the requirements of section 3A. (3) Any applicant aggrieved by a decision of the Authority to refuse to issue him a certificate of proficiency in fast rescue boats may appeal against the decision to the Administrative Appeals Board except where the only reason for the refusal is that the applicant has not paid the prescribed fee referred to in subsection (1). (L.N. 106 of 1998) Cap 478Z s 5 Record of certificates A record of all certificates of proficiency in survival craft and rescue boats and certificates of proficiency in fast rescue boats issued under these Rules and of the suspension, cancellation or alteration of, and any other matters affecting such certificates, shall be kept by the Authority. (Enacted 1996. L.N. 106 of 1998) Cap 478Z s 6 Lost, etc., certificates (1) Subject to subsection (2), where a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats issued to any seafarer has been lost, defaced or destroyed, the Authority may, upon payment of the prescribed fee, issue to the seafarer another certificate in like terms, and any such certificate so issued shall, for the purposes of these Rules, have the same effect as the certificate lost, defaced or destroyed, as the case may be. (2) The Authority- (a) shall not issue a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats pursuant to subsection (1) to a seafarer unless the seafarer supplies the Authority with such information as the Authority requires to satisfy the Authority that the certificate which it will replace has in fact been lost, defaced or destroyed; and (b) may waive or reduce the prescribed fee referred to in subsection (1) where he is satisfied that the certificate concerned has been lost, defaced or destroyed without fault on the part of the seafarer to whom it was issued. L.N. 106 of 1998) Cap 478Z s 7 Re-examination (1) If the Authority is of the opinion that the holder of a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats is, due to his age, illness, physical disability or general inefficiency, likely to be incapable of performing his duties, the Authority may by notice in writing to the holder of the certificate require him to undergo within the period specified in the notice a re-examination based on the syllabus specified in Schedule 1 in the case of a certificate of proficiency in survival craft and rescue boats or the syllabus specified in Schedule 1A in the case of a certificate of proficiency in fast rescue boats and conducted in accordance with Schedule 2. (2) If the holder of a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats who is required to undergo a re-examination under subsection (1)- (a) does not pass the examination; (b) is not permitted to take or complete the re-examination pursuant to section 5(2) of Schedule 2; or (c) fails or refuses without reasonable excuse to undergo the re-examination within the period specified in the notice,the Authority may by notice in writing sent to the holder cancel the certificate. (3) Where a certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats is cancelled under subsection (2) the holder shall forthwith deliver the certificate to the Authority. (4) Any person aggrieved by a decision of the Authority to cancel under subsection (2) his certificate of proficiency in survival craft and rescue boats or certificate of proficiency in fast rescue boats may appeal against the decision to the Administrative Appeals Board. (Enacted 1996. L.N. 106 of 1998) Cap 478Z s 8 Saving (1) A certificate issued under the repealed Rules and in force immediately before the commencement of these Rules shall be deemed to be a certificate issued under these Rules, and the provisions of these Rules shall apply accordingly. (2) For the purposes of this section, "repealed Rules" (已废除的规则) means the Merchant Shipping (Certificates of Proficiency in Survival Craft) Rules (Cap 281 sub. leg.) repealed by the Ordinance. (3) A certificate of proficiency in survival craft issued or deemed to be issued under these Rules and in force immediately before the commencement of the Merchant Shipping (Seafarers) (Certificates of Proficiency in Survival Craft) (Amendment) Rules 1998 (L.N. 106 of 1998) shall be deemed to be a certificate of proficiency in survival craft and rescue boats, and the provisions of these Rules shall apply accordingly.
