(Cap 281 section 114) [12 November 1965] L.N. 144 of 1965 (L.N. 86 of 1965) Cap 281F reg 1 Citation These regulations may be cited as the Merchant Shipping (Fees) Regulations. Cap 281F reg 2 Interpretation In these regulations, unless the context otherwise requires- "hourly rate" (每小时收费率) means the rate per hour calculated in accordance with regulation 7; (L.N. 352 of 1983) "office hours" (办公时间) means the hours between 9 a.m. and 5 p.m., and 9 a.m. and noon on Saturday, excluding general holidays within the meaning of the General Holidays Ordinance (Cap 149); (35 of 1998 s. 5) "surveyor" (验船师) means a Government surveyor; "tons" (吨) means gross tons, and in the case of a ship having alternative gross tonnages, the larger of those gross tonnages. (L.N. 139 of 1970) Cap 281F reg 3 Schedule of fees (1) Subject to regulation 5, the fees prescribed in the Schedule shall be payable in respect of the matters specified in relation thereto in that Schedule. (L.N. 247 of 1992; L.N. 252 of 1994) (2) Except where otherwise specified in the Schedule or by necessary implication, the fees prescribed for the issue of any certificate shall be in respect of a certificate valid for a period of 12 months. Cap 281F reg 4 Fees for service within Hong Kong Where the issue of any certificate or clearance is dependent upon the carrying out of any survey or inspection within Hong Kong during office hours any fee prescribed by these regulations shall include the services of a surveyor together with any travelling or other expenses involved. (L.N. 352 of 1983) Cap 281F reg 5 Fees for services outside Hong Kong (1) Where the issue of any certificate or clearance is dependent upon any survey or inspection to be undertaken outside Hong Kong by a surveyor sent from Hong Kong for that purpose, there shall be payable- (a) a fee calculated in accordance with subregulation (2) or (3); and (b) the travelling and subsistence expenses of the surveyor in such reasonable sum as the Director shall determine.(2) For any survey or inspection described in Section P, Q or R in Part II of the Schedule, the fee payable shall be the sum of $7645 for each period of 24 hours or part thereof during which the surveyor is absent from Hong Kong on account of the survey or inspection, and in addition, the fee specified in the relevant Sections of the Schedule. (L.N. 334 of 1994; L.N. 354 of 1994; L.N. 270 of 1995) (3) For any survey or inspection described in Sections A, B, C, D, E, G, H, I, J, K, L and O in Part II of the Schedule, the fee payable shall be- (44 of 1995 s. 143) (a) where the fee for the services is entirely determinable by the time involved, the sum of $7645, in lieu of an hourly rate, for each period of 24 hours or part thereof during which the surveyor is absent from Hong Kong on account of the survey or inspection; or (b) where the fee for the services is not determinable by the time involved, the sum of $15290 for the whole period during which the surveyor is absent from Hong Kong on account of the survey or inspection, and in addition, the fee specified in the relevant Sections of the Schedule; or (c) where the fee for the services is partly determinable and partly not determinable by the time involved, the aggregate of- (i) for the services determinable by the time involved, the sum of $7645 for each period of 24 hours or part thereof during which the surveyor is absent from Hong Kong, less the actual number of hours the surveyor is required to undertake that particular survey or inspection referred to in subparagraph (ii); and (ii) for the services not determinable by the time involved, the fee for the services specified in the relevant Sections of the Schedule. (L.N. 334 of 1994; L.N. 354 of 1994; L.N. 270 of 1995)(4) The duration of a surveyor's absence from Hong Kong shall be calculated with reference to the departure time and arrival time from and at Hong Kong. (5) Where part of the survey or inspection undertaken by a surveyor is done within Hong Kong and part of it is done outside Hong Kong, the fee payable for each part shall be calculated according to regulation 3 and this regulation respectively. (L.N. 252 of 1994) Cap 281F reg 5A Fees for sending documents by telegram, telex or post Where in connection with any service specified in Part II of the Schedule or the issue of a certificate specified in Part II of the Schedule it is, in the opinion of the Director, necessary to incur expense to transmit information, plans, calculations or other documents to places outside Hong Kong by telegram, telex or post there shall be payable in addition to the fee specified in Part II of the Schedule the expense involved. (L.N. 352 of 1983) Cap 281F reg 6 Fees for services outside office hours Except in the case of a service rendered by the Mercantile Marine Office or the Registry of Shipping or Port Control Section, where the issue of any certificate or clearance is dependent upon any survey or inspection or where any other service is required to be undertaken outside office hours, there shall be payable, in addition to the appropriate fee specified in these regulations and the Schedule, if any, a fee based upon the following scale- |
