[接上页] Cap 281F reg 9 Fees for attendance at legal proceedings or inquiries Where an officer of the Marine Department is required to attend any legal proceedings or inquiry in his capacity as a Government official there shall be payable in respect thereof- (a) where the attendance is in Hong Kong during office hours, a fee of $1115 for each hour or part hour of attendance; and (L.N. 247 of 1992; L.N. 334 of 1994; L.N. 270 of 1995) (b) where the attendance is outside Hong Kong- (i) a fee of $7645 for each period or part period of 24 hours during which the officer is absent from Hong Kong on account of the attendance; and (L.N. 334 of 1994; L.N. 270 of 1995) (ii) the travelling and subsistence expenses of the officer in such reasonable sums as the Director shall determine. (L.N. 247 of 1992)(c)-(d) (Repealed L.N. 247 of 1992) (L.N. 229 of 1978; L.N. 310 of 1989; L.N. 333 of 1993) Cap 281F reg 10 Charges for advice and examination of plans Remarks: Adaptation amendments retroactively made - see 64 of 1999 s. 3 Where the Director consents to survey, tender advice or examine plans in respect of the structure, machinery or equipment of a vessel in so far as such structure, machinery or equipment is to comply with statutory requirements or with any other requirements and no fee for such survey, advice or examination is prescribed, there shall be payable such reasonable sum in respect of such survey, advice or examination as the Director may agree with the applicant therefor, having regard to the nature and extent of the work involved. (L.N. 129 of 1967; L.N. 352 of 1983; 64 of 1999 s. 3) Cap 281F reg 11 Fees payable in advance Every fee shall be paid at the Marine Department in advance of the service in respect of which such fee is payable: Provided that the Director may in his discretion in any particular case permit any fee to be paid, in whole or in part, in arrear, and subject to such conditions as to security or time for payment as he may think fit. Cap 281F reg 11A Forfeiture of fees for failure to attend for examination Remarks: Adaptation amendments retroactively made - see 64 of 1999 s. 3 A fee paid by an applicant for examination for a local certificate of competency in accordance with item 3 of Part IV of the Schedule shall be forfeited to the Government if the applicant fails to attend for the examination at the time and place notified to him by the Director unless- (L.N. 247 of 1992; 64 of 1999 s. 3) (a) the applicant has given not less than 3 days' notice to the Director of his inability to attend for the examination; or (b) the Director is satisfied that the applicant was through circumstances beyond his control unable to attend for the examination. (L.N. 229 of 1978) Cap 281F reg 12 Services required for certain official purposes (1) No fee or charge shall be payable in respect of any copy of any certificate referred to in these regulations which is supplied at the request of a department of the Central People's Government, or the representative of a government other than the Government of the Hong Kong Special Administrative Region when the copy of a certificate is required for official purposes. (2) No fee specified in the Schedule shall be payable in respect of any service referred to in these regulations which is performed at the request of any department of the Government of the Hong Kong Special Administrative Region, any public body or the representative of any government other than the Government of the Hong Kong Special Administrative Region, but the Director may make such charge in respect of the service rendered as he may consider appropriate. (23 of 1998 s. 2; 64 of 1999 s. 3) Cap 281F SCHEDULE Remarks: Adaptation amendments retroactively made - see 64 of 1999 s. 3 [regulations 3, 5, 5A, 6, 7, 8, 11A & 12] PART I (No provision) ------------- PART II FEES FOR SURVEYS SECTION A-PASSENGER SHIPS AND SAFETY CERTIFICATE Note: (1) The fees prescribed under items 1 to 4 inclusive of this Section cover- (a) the survey of the hull, boilers and propelling machinery (including tests of the materials), and the inspection of the equipment of the ship including the lights and sound signals; and (b) the survey of a ship for load line if the 2 surveys are carried out concurrently.(2) The fees prescribed under items 1 to 4 inclusive of this Section do not cover- (a) the inspection of the crew accommodation referred to in Section M of this Part; (b) the survey of inflatable life rafts referred to in Section G of this Part; (c) the survey of a radio installation or any installation referred to in Section E of this Part.(3) In any case in which the duration of the certificate has been limited by the surveyor's declaration, owing to special reasons rendering one or more further surveys necessary within the ensuing 12 months, the total fees payable under items 2, 3, 4, 5(a), (b), (c) and (d) inclusive of this Section for certificates covering the period of 12 consecutive months shall not exceed that payable for a 12 months' certificate. |
