[接上页] 第十九条 违反本办法，构成走私行为、违反海关监管规定行为或者其他违反《海关法》行为的，由海关依照《海关法》和《中华人民共和国海关行政处罚实施条例》的有关规定予以处理；构成犯罪的，依法追究刑事责任。 第二十条 本办法下列用语的含义： “矿产品”，包括矿物燃料、润滑剂和相关材料，以及矿砂和金属矿石； “农产品”，包括林业产品； “船只”，本办法第四条第（六）项所述“船只”是指从事商业捕捞作业的渔船，其在一成员国注册并由《亚太贸易协定》各成员国的一个或者多个公民政府部门经营，或者由在该成员国注册的合伙人、企业、社团经营。该成员国的公民政府部门应当至少拥有该船只60%的资产净值；或者亚太贸易协定各成员国的公民政府部门应当至少拥有该船只75%的资产净值。但是在成员国间按照双边协议租借船只分享捕捞产品时，从商业捕捞船只上获得的产品也应当享受关税减让优惠； “加工船”，本办法第四条第（七）项所述“加工船”是指在船上仅对本办法第四条第（六）项中的产品进行加工生产的船只。由政府机构经营的船只或者加工船不受悬挂成员国国旗要求限制； “海关估价协定”，是指作为《马拉喀什建立世贸组织协定》一部分的《关于实施1994年关税与贸易总协定第7条的协定》。 第二十一条 本办法由海关总署负责解释。 第二十二条 本办法自2009年1月1日起施行。2001年12月30日海关总署令第94号公布的《中华人民共和国海关关于亚洲及太平洋经济和社会理事会发展中国家成员国关于贸易谈判的第一协定项下进口货物原产地的暂行规定》同时废止。 附件：1．亚太协定成员国名单 2．原产地证书样本 附件1 亚太协定成员国名单 中国、韩国、印度、孟加拉、斯里兰卡和老挝 孟加拉和老挝为最不发达成员国 附件2 SAMPLE CERTIFICATE OF ORIGIN Asia-Pacific Trade Agreement （Combined declaration and certificate） 1.Goods consigned from： （Exporter’s business name， address， country） Reference No. Issued in ……………. （Country） 2. General Conditions： To qualify for preference， products must： a）fall within a description of products eligible for preference in the list of concessions of an Asia-Pacific Trade Agreement country of destination； b）comply with Asia-Pacific Trade Agreement rules of origin. Each article in a consignment must qualify separately in its own right； and c）comply with the consignment conditions specified by the Asia-Pacific Trade Agreement rules of origin. In general， products must be consigned directly within the meaning of Article 11 hereof from the country of exportation to the country of destination. II. Entries to be made in the boxes Box 1 Goods Consigned from Type the name， address and country of the exporter. The name must be the same as the exporter described in the invoice. Box 2 Goods Consigned to Type the name， address and country of the importer. The name must be the same as the importer described in the invoice. For third party trade， the words “To Order” may be typed. Box 3 For Official Use Reserved for use by certifying authority. Box 4 Means of Transport and Route State in detail the means of transport and route for the products exported. If the L/C terms etc. do not require such details， type “By Air” or “By Sea”. If the products are transported through a third country this can be indicated as follows： e.g. “By Air” “Laos to India via Bangkok” |
