[接上页] diplomatic immunity under section 18, shall not be required to leave the country otherwise than in accordance with the diplomatic procedure applicable to diplomatic envoys accredited to that country. (ii) In the case of an official to whom section 18 is not applicable, no order to leave the country shall be issued other than with the approval of the Foreign Minister of the country in question, and such approval shall be given only after consultation with the Secretary General of the Council; and if expulsion proceedings are taken against an official, the Secretary General of the Council shall have the right to appear in such proceedings on behalf of the person against whom they are instituted. Section 23 The Secretary General shall co-operate at all times with the appropriate authorities of Members of the Council to facilitate the proper administration of justice, secure the observance of police regulations and prevent the occurrence of any abuses in connexion with the privileges, immunities and facilities enumerated in the present Annex. Article IX Settlement of disputes Section 24 The Council shall make provision for appropriate modes of settlement of: (a) disputes arising out of contracts or other disputes of a private character to which the Council is a party; (b) disputes involving any official of the Council who by reason of his official position enjoys immunity, if immunity has not been waived in accordance with the provisions of sections 19 and 21. Article X Supplementary agreements Section 25 The Council may conclude with any Contracting Party or Contracting Parties supplementary agreements adjusting the provisions of the present Annex so far as that Contracting Party or those Contracting Parties are concerned. 建立海关合作理事会的公约 本公约签约各国政府，考虑到为使各国海关制度达到最高度的协调和统一，特别对於和海关制度有关的海关技术和海关立法在发展和改进中存在的问题进行研究是可取的，深信 关心这些问题包含的经济和技术因素，促进各国政府在这些事务上的合作，对国际贸易将是有利的，经协商同意： 第一条 特建立海关合作理事会（下文中简称理事会）。 第二条 甲、理事会由下列成员组成： （1）本公约缔约各方； （2）有单独关境并在对外贸易关系方面享有自主权的政府，经在外交方面对其正式行为负责的本公约缔约一方政府提出，并经理事会批准的，可作为单独成员参加。 乙、按照本条甲款成为理事会成员的某一单独关境的政府，经在外交方面对其正式行为负责的缔约一方通知理事会撤销其成员资格时，其成员资格应即终止。 丙、每一成员应指派代表一人，及候补代表若干人代表该成员出席理事会。上述代表得由顾问协助。 丁、非成员国政府或国际组织可派代表以观察员身份列席理事会。 第三条 理事会的职权如下： 甲、研究本公约缔约各方认为符合本公约宗旨须加促进的有关海关业务合作方面的问题； 乙、从技术上和与之有关的经济因素上，审查各项海关制度，以便向各成员提出有可能实现最高度协调和统一的实际措施； 丙、草拟公约草案及修正案，并建议有关各国政府采纳； 丁、对於本理事会组织缔结的各项公约和由欧洲关税同盟研究小组制订的《海关税则商品分类目录公约》和《海关商品估价公约》提供各项建议，以保证其解释和实施上的一致 ；为此目的，并可按照上述公约的规定，执行各公约明确授予的职权； 戊、对本条丁款所指各公约的解释和实施如有争议，可以调解人的身份，根据上述公约的规定，提出解决该争议的建议；有争议各方得事先承认理事会的建议对该方具有约束力 ； 己、保证海关规章制度和程序方面的情况交流； 庚、在本公约宗旨范围内，主动地或应请求，向有关各国政府提供海关业务方面的情况或意见，并提出建议； 辛、与其他国际组织就其主管范围的事项进行合作。 第四条 理事会成员应向该会提供为执行其职务所必需和要求得到的消息和文件，但该会不得要求其成员提供导致扩散其机密的情报，如果这种情报一旦泄露将会妨碍其法律的执行，违 反公共利益或损害公私企业的合法商业利益。 第五条 建立常设技术委员会和秘书处以协助理事会工作。 第六条 甲、理事会应从其成员的代表中每年推选主席一人，副主席至少两人。 乙、理事会的议事规则应由其成员以三分之二以上的多数通过。 丙、理事会应按照《关於海关税则商品分类目录的公约》的规定，建立商品分类目录委员会，按照《关於海关商品估价的公约》的规定，建立估价委员会并应为第三条丁款所指 |
